As a condition to, and in consideration of, my use of the bike room located at 2345 Crystal Drive (the "Center"), I hereby certify, covenant and agree:

 

To abide by all Rules for the Bike Room at 2345 Crystal Drive. I further agree to assume all risk of any personal injury or loss of or property damage, and further agree to indemnify and hold harmless Fourth Crystal Park Associates LP, JBG SMITH Properties, JBG SMITH Properties LP,  and their affiliates, officers, agents, directors, shareholders, members, partners and employees thereof, against all claims and suits whatsoever arising from all injury, loss, illness, harm, cost, expense, claim, suit, or damage resulting from or related to my use of the Bike Room and the equipment and facilities located therein at 2345 Crystal Drive, except to the extent such an injury, loss, illness, harm, cost, expense, claim, suit, or damage is caused by the gross negligence or willful misconduct of such parties.

 

Fourth Crystal Park Associates LP, JBG SMITH Properties, JBG SMITH Properties LP, and their affiliates and agents (collectively “JBGS”) may prohibit using the Bike Room and/or revoke individual access privileges if the Bike Room facility is being misused.

 

JBGS takes no responsibility for Bikes or any other personal property or possessions left in the Bike Room or the lockers. Locks on lockers are permissible; however, all articles and locks must be removed at the end of each business day. JBGS reserves the right to remove any locks and the contents of any lockers when the contents are left overnight or for extended periods. I agree to waive all claims against JBGS related to such contents, including, but not limited to, claims for their replacement or reimbursement for their value, in the event they are so removed.

 

I acknowledge and agree to the terms of this Waiver of Liability governing the use and operation of the Bike Room. I agree that I will fully comply with these terms as they are amended from time to time.
